Your First Amendment rights protect your freedom of speech - not your right to profit off of it.

That being stated, you waive a portion of those rights when you agree to the legally binding Terms of Use agreement that ALL Social Media sites use. That's why he lost to Twitch and had to settle his suit out of court.
