Piracy is one thing, but Nintendo is also banning people who are playing on Switch 2 with their own purchased games or freely available homebrew games and apps.
It would be like someone downloading a bunch of beat 'em up games to play with the Switch port of OpenBOR and playing it on a MIG flashcard on Switch 2.
That person did nothing illegal but Nintendo banned the console from going online anyway.
