If the people making the copies were the ones being punished, I'd agree with you.

But the many of the people being caught are the ones who are purchasing what they believe are legitimate copies, and being scammed. Its not uncommon to make copies, slap a nearly identical lable on it and pass it off as legitimate. Purchasing one of those in a used gamestore, means you would have no idea the previous owner was a cheat.
