YouTube is merely adhering to the safe harbor provision of the DMCA. Which is law. The onus isn't on YouTube for this sort of behavior which is all too common. The onus should be placed where it belongs, which is the insufficient structure of the DMCA which was formed in the late 90's at the behest of the music industry to combat systems like Kazaa and Napster.
